This Data Processing Agreement (“DPA”) forms part of and is incorporated into the iStunt.com Terms of Service and governs the Processing of Personal Data by iStunt.com, Inc., a Nevada corporation (“iStunt,” “Company,” “we,” “us”) on behalf of users, members, subscribers, customers, affiliates, or sponsors (“User,” “you”).
This DPA applies solely to iStunt.com, iStunt Mobile, and the iStunt Directory and does not apply to Hubly, CRM services, or any third party software platform, which are governed by separate agreements.
For purposes of this DPA:
Applicable Data Protection Laws means all applicable privacy and data protection laws, including but not limited to GDPR, UK GDPR, CCPA, CPRA, and any other U.S. state or international privacy laws.
Controller means the entity that determines the purposes and means of Processing Personal Data.
Processor means the entity that Processes Personal Data on behalf of a Controller.
Personal Data means any information relating to an identified or identifiable natural person.
Processing means any operation performed on Personal Data, including collection, storage, use, disclosure, or deletion.
User Content means all data, information, images, files, text, and materials uploaded, submitted, or provided by Users.
Capitalized terms not defined herein have the meanings set forth in the Terms of Service.
The User is the Controller of all Personal Data submitted, uploaded, published, or otherwise made available through iStunt.com.
iStunt acts as a Processor with respect to Personal Data processed solely for the purpose of providing directory services, profile hosting, discovery, search, and platform functionality as described in the Terms of Service.
Nothing in this DPA creates joint controllership. Users retain full responsibility for the legality, accuracy, and permissibility of all Personal Data they submit.
iStunt Processes Personal Data solely for the following purposes:
Hosting and displaying user profiles and directory listings
Providing search, discovery, and contact functionality
Maintaining platform security and integrity
Providing customer support
Enforcing Terms of Service and Acceptable Use Policy
Complying with legal obligations
Processing is limited to the duration of the User’s relationship with iStunt and as otherwise permitted under applicable law and the Data Retention Policy.
The User represents and warrants that:
All Personal Data provided has been lawfully obtained
All required notices and consents have been provided
No Personal Data violates privacy, publicity, or intellectual property rights
No sensitive data is uploaded unless explicitly permitted by law
The User has authority to make Personal Data public where applicable
The User assumes full responsibility for compliance with Applicable Data Protection Laws.
iStunt Processes Personal Data only in accordance with:

The Terms of Service
The Privacy Policy
User initiated actions within the platform
The Terms of Service and related policies constitute the User’s complete documented instructions.
iStunt ensures that personnel authorized to Process Personal Data are subject to confidentiality obligations, whether contractual or statutory.
iStunt implements reasonable administrative, technical, and organizational safeguards designed to protect Personal Data against unauthorized access, disclosure, alteration, or destruction.
No method of transmission or storage is completely secure, and iStunt does not guarantee absolute security.
iStunt may engage subprocessors for hosting, infrastructure, analytics, support, or security purposes.
By using iStunt.com, the User provides general authorization for such subprocessors, provided they are subject to appropriate confidentiality and data protection obligations.
iStunt will notify Users without undue delay upon becoming aware of a Personal Data Breach involving Personal Data under iStunt’s control, unless notification is not required under Applicable Data Protection Laws.
Users are responsible for responding to requests from data subjects.
To the extent legally required, iStunt will provide reasonable assistance at the User’s expense, taking into account the nature of Processing and available information.
Personal Data is retained in accordance with the iStunt Data Retention Policy.
Upon termination of the User’s account, iStunt may retain Personal Data as required for legal, regulatory, backup, dispute resolution, or enforcement purposes.
Personal Data may be processed and stored in the United States or other jurisdictions where iStunt or its service providers operate.
Users acknowledge that data protection laws in such jurisdictions may differ from those in their country of residence.
To the extent the CCPA or CPRA applies:
iStunt acts as a service provider
iStunt does not sell or share Personal Data
iStunt Processes Personal Data solely for business purposes permitted by law
The User agrees to indemnify, defend, and hold harmless iStunt.com, Inc., its officers, directors, employees, contractors, and affiliates from all claims, damages, fines, penalties, and expenses arising from:
User provided Personal Data
Failure to obtain consent
Violations of privacy or data protection laws
Breach of this DPA
To the maximum extent permitted by law, iStunt shall not be liable for indirect, incidental, consequential, special, or punitive damages related to data Processing.
Total liability is limited as set forth in the Terms of Service.
This DPA is governed by the laws of the State of Nevada, without regard to conflict of law principles.
